The High Court has sent notices to the state government after hearing about 40 petitions challenging the rule issued on April 1, 2022 regarding the transfer of state government primary teachers. The High Court may make an interim order granting relief to the applicant teachers. It may replace the applicants or participate, although the authorities will not make any order regarding the posting till the next hearing. The applicant is requested to apply the rule of appointing seniority many BRC CRCs to the original place with retrospective effect from the time of appointment in the school. Petitioner's counsel submitted that state government regulations have recently been issued regarding transfer of teachers. If the teachers teaching in Std. 1 to 5 want to go as a teacher in Std. 6 to 8 as part of the option selection, then they are required to pass Tet 2 examination. If the state has not taken this exam after the year 2017, then where can the teachers bring the certificate. These rules currently provide sufficient relief. The petitioner also submitted that when the teacher's BRC or CRC is placed for a specified period of time, the senior for his vacancy comes on the basis of it and by recruiting or transferring the teacher. However, according to the new rules, BRC CRCs are relocated to their original school after completion of tenure so that the new teacher who has been transferred has to bear the brunt of injustice.
